Porter Hedges IP Team Secures Permanent Injunctions in Two Trademark Cases

Porter Hedges recently obtained agreed permanent injunctions in two separate trademark cases.

ZoFrost & Co LLC v. Arsh Khusro, Individually, Leo Frost Jewelry LLC, and Leo Frost & Company LLC, No. 4:22-cv-00812 (S.D.Tex.)

Porter Hedges represented ZoFrost, a celebrity custom jewelry maker, in a case alleging the Defendants were causing confusion in the custom jewelry marketplace. After the Plaintiff filed the lawsuit and a Motion for Preliminary Injunction, the Defendants agreed to be permanently enjoined from using phrases that include the term “Frost.”

Freshman Fun Box, LLC v. Darwin Creative Group, LLC and Ladawrin Cumby, Individually, No. 3:21-cv-02082-b (N.D.Tex.)

Porter Hedges represented Freshman Fun Box, LLC, a clothing retailer, in a trademark infringement case against Darwin Creative Group, LLC. The case involved a trademark to “I’M HBCU.” The Defendants agreed to be permanently enjoined from using “I’M HBCU,” “I AM HBCU,” and any other confusingly similar term.
